The TFR completed the investigation of the first criminal case related to a fire in the Kemerovo shopping and entertainment center "Winter Cherry", the victims of which were 60 people. Accusations in the final version are presented to three defendants, four more will be accused in the near future. At the same time, two of them were charged less serious than before.

In Kemerovo, investigators of the Main Directorate for the investigation of especially important cases of the TFR presented the final accusations to the defendants of the criminal case on the fire in the SEC "Winter Cherry" - the general director and employee of the company "System Integrator" Igor Polozinenko and Alexander Nikitin serving the fire-fighting system of the shopping center and the chief of the fire department Sergei Genin, who extinguished the fire.

As Nikolai Bylenok, a lawyer of Alexander Nikitin, told Kommersant, his client was previously incriminated with Part 3 of Art. 238 of the Criminal Code of the Russian Federation (the performance of work or the provision of services that do not meet the requirements of the safety of life or health of consumers, resulting in the death of two or more persons by negligence), and now - part 3 of Art. 219 of the Criminal Code (violation of fire safety requirements, which caused the death of two or more persons). The new accusation, said the defender, is less serious, since according to him, not ten years of imprisonment, but seven are envisaged as the maximum punishment. The accusation was also softened by Igor Polozinenko.

As a source close to the investigation told Kommersant, during the investigation the position of Mr. Polozinenko has radically changed. "Earlier, Igor Polozinenko planned to plead guilty, counting on the condescension of the court, now he, like Nikitin, did not admit the blame," the source said. The culprit of all his problems is the ex-general director of OAO Kemerovo Confectionery Combine (KKK, owned by the burned Winter Cherry) Yulia Bogdanov (she has not yet been charged). According to investigators, Igor Polozinenko, having taken for service the fire-prevention system installed in the "Winter Cherry", offered for 7 million rubles. bring it into working order. Mrs. Bogdananova, obviously having consulted with the owners of the KKK (they are not attracted to criminal liability yet), decided to save money. As a result, the system did not work during a fire: the fire did not automatically inflame the fire, and there was no fire warning.

Elena Kiseleva, the lawyer of the head of the fire and rescue unit number 2 of Sergei Genin, told Kommersant that her client did not change the charge, was also charged with negligence (part 3 of article 293 of the Criminal Code), which resulted in the death of 37 people through imprudence. Ms. Kiseleva said that the Serbsky Institute of Psychiatry, where Sergey Genin was sent for additional psycho-psychiatric examination, gave an opinion on the sanity of the firefighter. "Organized, collected, able to control his actions," - said, in particular, in the conclusion. Elena Kiseleva recalled that Sergei Genin is the only one who managed to save a man in a fire.

The coordinator of the criminal practice of the public center for assistance to victims in the "Winter Cherry" lawyer Alexander Balyan believes that the re-qualification of the charge against the employees of the company "System Integrator" means that the investigation now considers them officials "responsible for compliance with fire safety rules at the site."
