As it became known to Kommersant, the investigative department of the Ministry of Internal Affairs completed the investigation of the criminal case about the theft of more than 752 million rubles. at the construction of the stadium "Arena Baltika" in Kaliningrad, which hosted matches of the World Cup. Three of his figurants are already acquainted with the materials of the investigation. The investigation expects to use the verdict on their case as evidence of guilt of the co-owners of the "Summa" group Ziyavudin and Magomed Magomedov who are charged with organizing the criminal community.
In the final version of the charge of embezzlement from the budget by fraud (Part 4, Article 159 of the Criminal Code) more than 752 million rubles. presented to the former Minister of Construction of the Kaliningrad Region Amir Kushhov, Deputy Head of the Regional Department for Capital Construction Sergey Tribunsky and Deputy General Director of the company "GlobalElectroservice" (part of the "Sum" group) Hachim Eristov. All of them have been in custody for more than a year and have recently begun to get acquainted with the case materials. Two more defendants, including the general director of "GlobalElectroservice" Eldar Nagaplov, were arrested in absentia and declared on the international wanted list.
The investigation of this criminal case began in 2014 at the regional level. Notable results appeared only three years after he was transferred from Kaliningrad to Moscow to the investigative department of the Ministry of Internal Affairs. At the end of June last year, at the request of the Tverskoy investigation, the district court of the capital imprisoned Amir Kushhov, Sergei Tribunsky and Hachim Eristov.
As established by law enforcement agencies, in 2013 OJSC "GlobalElectroservice" won an auction for the preparation of the site on the island of October for the construction of the stadium "Arena Baltika" (in the 2018 World Cup it was used under the name "Kaliningrad" .- "Kommersant"). At the same time, a contract was signed with the regional government for 850 million rubles, according to which the contractor had to complete the engineering preparation of the 22 hectare site, in particular, to fill 1.6 million cubic meters of sand to strengthen weak soils, to produce 1.779 million linear meters of vertical belt drainage pipes, as well as to build temporary roads.
In September 2014, Amir Kushkhov and Sergei Tribunsky took these works from the company of Eldar Nagaplova. However, as the investigators found, their quality turned out to be very doubtful. In particular, it was found that one of the firms of subcontractors supplied sand to the site for the future stadium sand, allegedly not corresponding to the technical task. This was confirmed by the examination. However, the builders themselves claimed that the sand was of proper quality. According to them, it changed its structure due to the fact that the work was carried out in the swampy terrain.
At the same time, the lawyers of the defendants, during the recent consideration of the next appeal appeal for the arrest of their clients, referred to the decisions of the arbitration courts, where the claims filed with the "GlobalElectroservice" in 2016 were addressed by the Kaliningrad government. First, the Arbitration Court of the Kaliningrad Region, and then the Court of Appeal, did not find any violations in the activities of the builders. Left these decisions in force in January 2018 and the 13th Arbitration Court of Appeal.
However, the fate of the defendants, who do not admit their guilt, this did not affect. Moreover, it is very likely that in the near future, participation in the criminal community can be added to the incriminated all three frauds (Article 210 of the Criminal Code of the Russian Federation). The theft of the construction of "Arena Baltica" is one of seven episodes of fraud and embezzlement, which are blamed for the alleged organizers of the FSO - co-owners of the "Summa" group Ziyavudin and Magomed Magomedov. As already told Kommersant, both, as well as the ex-head of the company Intex Arthur Maxidov, the FSB and GUEBiPK officers of the Ministry of Internal Affairs were detained on March 30, 2018. The Tverskoy District Court of Moscow authorized their arrests, and the Moscow City Court dismissed the defense's complaints. According to Kommersant's information, the investigation believes that it was the Magomedov brothers who organized embezzlement in Kaliningrad, and in addition, they allegedly initiated frauds for 650 million rubles. while building another stadium for the World Cup - Zenit Arena in St. Petersburg. According to the investigation, the damage caused by the brothers to the state is estimated at more than 2.5 billion rubles.
Lord Magomedov and Maxidov also deny their involvement in the incriminated acts. Their lawyers refused to comment yesterday, referring to the investigator's subscription on the non-disclosure of the case materials. At the same time it is already obvious that the investigation is going to use the verdict on the embezzlement case in Kaliningrad as proof of the guilt of the Suma owners in their future process.
